MegoForex.com / RBP FINIVIS PRIVATE LIMITED does not control or manage the actual execution of transactions between users and its channel partners — banks and other financial institutions authorised by the Reserve Bank of India (RBI) to deal in foreign exchange. The company shall not be held responsible for any non-performance, delay, or breach of obligations arising from agreements entered into between users and channel partners.

Amendments

The company reserves the right, at its sole discretion, to amend, update, add, or remove portions of these Terms of Use at any time without prior written notice. It is your responsibility to review these Terms of Use periodically. Your continued use of the Website following the posting of changes will mean that you accept and agree to the revisions.

Undertakings of a User

By accessing or using the Website, you agree and undertake not to host, display, upload, modify, publish, transmit, update, or share any information that:

14. You shall not engage in any activity that could create legal liability for MegoForex.com / RBP FINIVIS PRIVATE LIMITED or cause the company to lose the services of its internet service providers or other business partners.
15. You shall not use any deep-link, page-scrape, robot, spider, or other automatic device, program, algorithm, or methodology to access, acquire, copy, or monitor any portion of the Website or any Content, or to reproduce or circumvent the navigational structure or presentation of the Website to obtain any materials or information.

You agree to grant MegoForex.com / RBP FINIVIS PRIVATE LIMITED a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the database rights or any other rights you have in your information, in any media now known or not currently known, solely to enable us to use the information you supply us with in accordance with the Terms of Use and applicable laws.
23. MegoForex.com / RBP FINIVIS PRIVATE LIMITED shall have all rights to take necessary action and claim damages that may occur due to your involvement in any act in contravention of any law or causing any harm to the company, its channel partners, or users.

Account Termination or Suspension

MegoForex.com / RBP FINIVIS PRIVATE LIMITED reserves the right, at its sole discretion, to suspend, restrict, or terminate access to the Website or any of its services without prior notice if a user:

However, the company does not act as an agent for banks, currency exchange companies, telecom operators, SIM card providers, insurance companies, or any other third-party service providers. Accordingly, the company shall not be responsible for the execution of transactions between users and channel partners, including issues such as delays, damaged banknotes, old series notes, marked or counterfeit currency, unauthorised forex card transactions, delays in card funding, inactive SIM cards, insurance discrepancies, or disputes arising from channel partners' operational standards. Users are responsible for verifying the authenticity and condition of currency at the time of delivery.
5. If, at any stage, the documents or information provided by you are found to be incomplete, inaccurate, inconsistent, or in violation of applicable laws, regulations, RBI guidelines, or government policies, the concerned channel partner may cancel the transaction at its sole discretion without prior notice. In such cases, any funds deposited by you will be refunded within thirty (30) days after deducting applicable cancellation or processing charges. You shall not raise any claim against MegoForex.com / RBP FINIVIS PRIVATE LIMITED beyond what is provided under the applicable cancellation policy.
6. MegoForex.com / RBP FINIVIS PRIVATE LIMITED shall not be responsible for any transactions carried out by users on third-party websites that may be linked to or referenced from the platform.
7. When undertaking foreign exchange transactions through the platform, you represent and warrant that the total amount of foreign exchange purchased or remitted through all sources, including this service, remains within the limits prescribed by the Reserve Bank of India (RBI) and complies with applicable exchange control regulations.
8. The company shall not be responsible for any failure, malfunction, or service deficiency related to Forex Travel Cards issued by banks, exchange companies, or other channel partners — including bank server downtime, card malfunction at POS terminals, ATM authentication failures, non-working PINs, delays in card funding, or disputes regarding forex card transactions. Users must contact the issuing bank directly. Insurance policies purchased through the platform are governed by the issuing institution's regulations, and any disputes must be resolved directly between the user and the issuing institution.
9. MegoForex.com / RBP FINIVIS PRIVATE LIMITED shall not be liable for any acts carried out by its officers, employees, agents, representatives, or assigns that fall outside the scope of their official duties. The company does not charge any commission or additional fee to expedite transactions. If any individual misrepresents services or offers services not listed on the Website, users should report such incidents promptly to the designated grievance officer.
10. The company shall not be liable for any interruption or unavailability of services resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, regulatory restrictions, network failures, or other unforeseen events.
11. Under no circumstances shall MegoForex.com / RBP FINIVIS PRIVATE LIMITED be liable for any loss, damage, or injury of any nature suffered by you or by any person acting on your behalf or benefiting from your transactions. By accepting these Terms of Use, you acknowledge that the company may store and process your personal information and account details within its systems for the purpose of providing services. GST / Taxation on Foreign Exchange Transactions

All foreign exchange transactions are subject to government taxation. As stipulated by the Government of India, any conversion from one currency to another — sale, encashment, or remittance — will be charged GST/SGST on the gross amount of currency exchanged as per the following slabs:

GST/SGST rates and rules may change from time to time. Our channel partners will charge applicable GST/SGST. While efforts will be made to update amendments on the Website, we take no responsibility if the latest amendments are not immediately updated.

Foreign Exchange Products

We provide a platform for transaction of foreign exchange products limited to bank-operated Foreign Exchange Cards, vendors for currency notes, and remittance of foreign exchange. The transaction is facilitated through third-party vendors only, and we are in no way an agent or in any way responsible for the execution of the transaction. If there is any dispute, please contact the third-party vendor for resolution. MegoForex.com / RBP FINIVIS PRIVATE LIMITED will not be liable for any claim arising out of any such issue.

You may access the portal and select foreign exchange as per your needs — in the form of a multi-currency card (prepaid and reloadable), currency notes, or travellers' cheques.

Cancellation & Refund Policy (Forex Transactions)

True Zero Markup Forex Card

1. The Zero Markup on Interbank Rate offer is applicable only to MegoForex.com / RBP FINIVIS PRIVATE LIMITED "“ Thomas Cook Forex Cards during Indian banking hours and applies only to: USD, EUR, GBP, AUD, CAD, SGD, and CHF.
2. Live Zero Markup Interbank Rates are displayed on the Website. These rates may differ slightly from interbank rates on search engines or other platforms due to variations in data sources and refresh intervals. Interbank rates may not be available during non-market hours or on bank holidays.
3. The Zero Markup Interbank Rate applies only to the loading of MegoForex.com / RBP FINIVIS PRIVATE LIMITED "“ Thomas Cook Forex Cards and does not apply to cross-currency conversions or transactions where the payment currency differs from the currency loaded on the card.
4. Zero Markup Interbank Rates are applicable only for forex card purchase (BUY) and reload transactions and are not applicable for card unload or refund transactions.
5. Zero margin or interbank rates are available only for forex card transactions involving selected currencies, in certain cities, and for orders valued at ₹1.5 lakh or above, subject to use of the promotional code "ZEROMARKUP."
6. The Zero Markup Interbank Rate Offer is valid for a limited period. MegoForex.com / RBP FINIVIS PRIVATE LIMITED reserves the right to modify, withdraw, or discontinue this offer at any time without prior notice.

Single Currency Forex Cards

Single Currency Forex Cards are designed primarily for students and include special offers available through the Student Travel Card program. All promotional offers listed on the platform are valid only for a limited duration and may be withdrawn or modified without prior notice. For complete details and eligibility criteria, users are advised to review the Terms and Conditions applicable to the Single Currency Forex Card and ensure that the selected card variant corresponds to the Single Forex Card option.

Travel Insurance

All insurance-related products available through the platform are governed by the rules and regulations issued by the Insurance Regulatory and Development Authority of India (IRDAI). Any offers or insurance products displayed on the portal are subject to the official offer documents issued by the respective insurer. Users are advised to carefully review these documents before purchasing or enrolling in any insurance policy.

MegoForex.com / RBP FINIVIS PRIVATE LIMITED does not act as an agent for the insurer and does not endorse or recommend any specific insurance policy. All insurance products are promoted solely by the respective insurance companies, and users are responsible for reviewing and understanding the terms and conditions before entering into any insurance agreement.

By proceeding with the purchase of an insurance policy, you agree to indemnify MegoForex.com / RBP FINIVIS PRIVATE LIMITED and its officers from any claims, liabilities, or disputes arising in connection with such policies. All claims, disputes, or issues related to insurance policies must be addressed directly with the issuing insurer.

Chargebacks

Chargebacks are governed by our Chargeback Policy, which sets out the valid and invalid grounds for raising a chargeback, how to raise a dispute with us directly, our representment process and timelines, and the consequences of an invalid or fraudulent chargeback. In the event of any conflict between these Terms and that Policy specifically concerning chargebacks, the Chargeback Policy prevails.

Tour Bookings and Travel-Related Products

Travel bookings and related services listed on the portal are provided by independent third-party vendors and are not operated directly by MegoForex.com / RBP FINIVIS PRIVATE LIMITED. Any changes, modifications, or cancellations are governed by the specific terms and conditions set by the respective vendor.

Once a travel or tour booking has been completed through the platform, any modifications or cancellations can only be made at the discretion of the third-party vendor and in accordance with their policies. The booking then constitutes a direct contractual agreement between the user and the tour operator or vendor. MegoForex.com / RBP FINIVIS PRIVATE LIMITED does not assume responsibility for such bookings.

Any cancellation requests related to travel or tour bookings must be processed directly through the third-party vendor responsible for the listing.

International SIM Cards

International SIM cards displayed on the portal are offered by third-party vendors for the convenience of users. MegoForex.com / RBP FINIVIS PRIVATE LIMITED does not act as an agent or representative of any SIM card operator and shall not be responsible for the services provided by such operators. Any disputes related to SIM card services must be addressed directly with the respective SIM card provider.

Once a user confirms the purchase of a SIM card through the platform, the product will be shipped to the user and activated in accordance with the selected requirements or any pre-approved activation conditions.

Free International SIM Offer

1. The Free International SIM offer is available only in selected cities, including New Delhi, Gurgaon, Noida, Faridabad, Mumbai, Pune, Bengaluru, Chennai, Hyderabad, Kolkata, Jaipur, Chandigarh, Amritsar, Panchkula, Mohali, Ludhiana, Jalandhar, Lucknow, and Kanpur.
2. This offer is applicable only when purchasing or reloading MegoForex.com / RBP FINIVIS PRIVATE LIMITED "“ Thomas Cook co-branded Forex Cards. The free SIM card will be delivered only along with the forex card and cannot be delivered separately or after the card delivery has been completed.
3. The Free International SIM enables users to receive unlimited incoming calls and use WhatsApp text messaging free of charge for up to 30 days after activation. The WhatsApp feature supports only text-based communication. WhatsApp voice calls, image sharing, video messages, and voice notes are not supported.
4. The Free International SIM is valid only for the following destination regions: Europe (Schengen countries), United Kingdom, Australia, Singapore, Malaysia, and Thailand. MegoForex.com / RBP FINIVIS PRIVATE LIMITED reserves the right to modify, add, or remove countries at its discretion.
5. The SIM card cannot be used within India and will function only in the selected destination country. Users may select the desired SIM activation date as early as the travel date or any date within 30 days from the travel date.
6. The SIM card will remain active until the last day of travel or for 30 days from the date of activation, whichever occurs earlier. If the user wishes to retain the number for future use, an additional fee may apply.
7. The SIM card supports Nano, Micro, and Macro SIM formats. For eSIM compatibility, users are advised to contact Next Cellular customer support. SIM activation details and instructions will be provided in the welcome email sent upon activation.
8. The Free International SIM is a third-party product provided and managed by Commbitz India Pvt. Ltd. MegoForex.com / RBP FINIVIS PRIVATE LIMITED does not assume responsibility for any issues arising from SIM usage. The service provider may contact customers regarding optional upgrades to paid voice or data plans.
9. For any grievances related to the International SIM, customers may contact the NextCare WhatsApp support line in India at +91 7717309363.
10. This promotional offer is available for a limited period, and MegoForex.com / RBP FINIVIS PRIVATE LIMITED reserves the right to modify, suspend, or withdraw the offer at any time without prior notice.
11. The Free International SIM will be provided only with new forex card orders valued at ₹1,00,000 or above.
12. Free incoming calls under this offer are available only within the United Kingdom and European Union regions.

Cancellation of SIM Cards

• If a SIM card has been purchased but not yet delivered — full refund within 21 working days.
• If the SIM card has been delivered but not yet activated — 50% of the purchase amount will be refunded.
• Cancellation is not permitted once the SIM card has been activated.

MegoForex.com / RBP FINIVIS PRIVATE LIMITED acts only as a facilitator for the listing and purchase of SIM card services and does not assume liability for the functionality, performance, or service quality of the SIM card provider.

Delivery Information

Payment Convenience Fee

Users and channel partners must comply with all applicable laws, regulations, and guidelines governing foreign exchange transactions and financial services. These include, but are not limited to:

• Foreign Exchange Management Act (FEMA), 1999 and associated RBI guidelines
• Anti-Money Laundering (AML) Guidelines issued by the Reserve Bank of India
• Information Technology Act, 2000, as amended by the Information Technology (Amendment) Act, 2008
• Prevention of Money Laundering Act, 2002
• Foreign Contribution Regulation Act (FCRA), 1976
• Income Tax Act, 1961
• Any rules, notifications, or circulars issued by the Reserve Bank of India from time to time, including the Exchange Control Manual

All parties using the payment facilities and services of MegoForex.com / RBP FINIVIS PRIVATE LIMITED must ensure full compliance with these laws and regulations.

RBI and Regulatory Compliance

All foreign exchange transactions conducted through the Website are subject to the rules, regulations, and guidelines issued by the Reserve Bank of India (RBI) under the Foreign Exchange Management Act (FEMA), 1999, and other applicable laws.

Execution of transactions may depend on regulatory approvals, documentation requirements, and compliance with applicable limits prescribed by the RBI.

MegoForex.com / RBP FINIVIS PRIVATE LIMITED reserves the right to reject, delay, or cancel any transaction that does not comply with applicable regulatory requirements.

Indemnity

You agree to indemnify and hold harmless MegoForex.com / RBP FINIVIS PRIVATE LIMITED, along with its affiliates, subsidiaries, group companies, licensees, officers, directors, employees, and agents, against any claims, demands, losses, liabilities, penalties, or legal proceedings — including reasonable legal fees — that arise from:

1. By applying for the issuance of the Multi Currency Forex Card, the applicant confirms that all information provided in the application is accurate and complete, and that they are eligible to apply for an internationally valid forex card. If the application is approved, the applicant agrees to be bound by the applicable Terms and Conditions governing the forex card, as amended from time to time. Usage of the card will be deemed acceptance of those Terms and Conditions.
2. The applicant authorises MegoForex.com / RBP FINIVIS PRIVATE LIMITED and its associates to verify the information provided in the application, including conducting verification at the applicant's residence or workplace, or contacting the applicant's employer, bank, credit bureau, the Reserve Bank of India (RBI), or other relevant sources as necessary to verify information and maintain the account in good standing.
3. The applicant acknowledges that the purchase and use of foreign exchange are subject to regulations, limits, and guidelines issued by the Reserve Bank of India and applicable laws.
4. The applicant undertakes that all usage of the Multi Currency Forex Card will comply with the Foreign Exchange Management Act (FEMA), 1999, RBI exchange control regulations, and all other applicable laws and regulations in force from time to time. If any information provided by the applicant is found to be incorrect or misleading, or if the card is used in violation of applicable laws, the applicant agrees to bear full responsibility for any penalties, regulatory actions, or legal consequences that may arise.
5. The applicant acknowledges and agrees that MegoForex.com / RBP FINIVIS PRIVATE LIMITED may act upon requests made by authorized individuals for reloading the forex card issued to the applicant.
6. In cases where the forex card is issued at the request of the applicant's employer, the applicant authorises MegoForex.com / RBP FINIVIS PRIVATE LIMITED to act upon instructions from the employer for card reload, cancellation, or refund.
7. The applicant agrees to surrender any unused balance exceeding USD 2,000 (or its equivalent) on the card within 180 days after completion of travel, in accordance with FEMA guidelines.
8. The applicant acknowledges that in certain circumstances the forex card may be over-utilised, resulting in a negative card balance due to transactions being processed on behalf of the cardholder. In such cases, the applicant accepts responsibility to repay the outstanding negative balance to MegoForex.com / RBP FINIVIS PRIVATE LIMITED. The company and/or Thomas Cook reserve the right to recover such balances by debiting the applicant's accounts or any prepaid card held with any bank, without prior notice.
9. The applicant acknowledges that if an incorrect card number is provided for a reload request, resulting in funds being loaded onto the wrong card, MegoForex.com / RBP FINIVIS PRIVATE LIMITED shall not be responsible for such errors.
10. The applicant agrees that all applicable fees associated with the forex card are non-refundable.
11. The applicant understands that ATM machines and EDC terminals are automated systems that may occasionally encounter operational errors. The applicant agrees to indemnify MegoForex.com / RBP FINIVIS PRIVATE LIMITED and Thomas Cook against any claims arising from such machine or mechanical failures.
12. The applicant acknowledges that the alert facility provided by MegoForex.com / RBP FINIVIS PRIVATE LIMITED allows the cardholder to receive notifications regarding transactions and card events through SMS or other communication channels.
13. The applicant confirms that they have read and understood the Terms and Conditions related to the alert facility. If the application is accepted, the applicant agrees to comply with these terms, including any amendments made from time to time.
14. The applicant certifies that all details provided in the application form are accurate and consents to receiving notifications and information through the alert facility. The applicant agrees to notify MegoForex.com / RBP FINIVIS PRIVATE LIMITED promptly in case of any changes to the information provided.
15. The applicant agrees to provide additional information or documentation, including any Know Your Customer (KYC) requirements, as may be requested by MegoForex.com / RBP FINIVIS PRIVATE LIMITED from time to time in accordance with regulatory or statutory guidelines.
16. The applicant confirms receipt of a sealed Multi Currency Forex Card kit issued by MegoForex.com / RBP FINIVIS PRIVATE LIMITED.
17. The applicant acknowledges that the forex card will not be funded if there is any violation of FEMA limits, applicable regulatory restrictions, or discrepancies in KYC documentation. In such cases, the applicant agrees not to hold MegoForex.com / RBP FINIVIS PRIVATE LIMITED or Thomas Cook responsible for the non-funding of the card.
18. The cardholder irrevocably authorises the issuing bank to block, suspend, or terminate the forex card if the cardholder's details or transactions appear on any watch list maintained by the bank, RBI, or other regulatory authorities, or if the cardholder's verification fails against databases such as NSDL. In such cases, the cardholder agrees to approach the issuing bank directly for the refund of any remaining balance on the card in accordance with the bank's refund procedures.

Declaration for Customers Funding / Reloading "“ Thomas Cook Forex Cards

Customers funding or reloading the MegoForex.com / RBP FINIVIS PRIVATE LIMITED "“ Thomas Cook Multi Currency Forex Card are required to acknowledge and agree to the following declarations:

1. I hereby apply for the issuance of the MegoForex.com / RBP FINIVIS PRIVATE LIMITED Multi Currency Forex Card and confirm that all information provided in the application is accurate and complete. I also confirm that I am eligible to apply for an internationally valid forex card. If my application is accepted, I agree to comply with the Terms and Conditions governing the card, as amended from time to time. Usage of the card will be deemed as acceptance of those terms.
2. I authorize MegoForex.com / RBP FINIVIS PRIVATE LIMITED and/or its associates to verify any information provided by me, including conducting verification at my office or residence, or contacting my employer, bank, credit bureau, the Reserve Bank of India (RBI), or other relevant authorities to obtain or share information necessary for maintaining the account.
3. I acknowledge that the purchase and use of foreign exchange are governed by the regulations and limits prescribed by the Reserve Bank of India and other applicable laws.
4. I undertake that my usage of the Multi Currency Forex Card will strictly comply with the Exchange Control Regulations issued by the RBI and all applicable laws, including the Foreign Exchange Management Act (FEMA), 1999. In the event that the information provided by me is inaccurate or if I fail to comply with these regulations, I agree to bear full responsibility for any penalties or legal actions imposed under applicable laws.
5. I acknowledge and agree that MegoForex.com / RBP FINIVIS PRIVATE LIMITED may act upon reload requests made by authorized individuals for the forex card issued in my name.
6. If the forex card has been issued at the request of my employer, I authorize MegoForex.com / RBP FINIVIS PRIVATE LIMITED to act upon instructions from my employer regarding reloads, cancellations, or refunds associated with the card.
7. I understand that any unused balance exceeding USD 2,000 or its equivalent must be surrendered within 180 days after completion of travel, in accordance with FEMA regulations.
8. I acknowledge that certain circumstances may result in the forex card being over-utilised, which may cause a negative balance on the card. In such cases, I agree to reimburse MegoForex.com / RBP FINIVIS PRIVATE LIMITED for the amount paid on my behalf for goods or services. I further acknowledge that the company and/or Thomas Cook may recover such negative balances by debiting my bank account or any prepaid card held with any bank without prior notice.
9. I acknowledge that I bear the risk of providing an incorrect card number for reload purposes. If funds are credited to the wrong card due to incorrect details provided by me, MegoForex.com / RBP FINIVIS PRIVATE LIMITED shall not be held responsible.
10. I understand and agree that all applicable fees associated with the forex card are non-refundable.
11. I acknowledge that ATM machines and EDC terminals are automated systems that may experience operational errors. I agree to indemnify MegoForex.com / RBP FINIVIS PRIVATE LIMITED and Thomas Cook against any claims arising from machine or mechanical errors during card usage.
12. I understand that the alert facility offered by MegoForex.com / RBP FINIVIS PRIVATE LIMITED allows me to receive customised notifications regarding card transactions and events via SMS on my registered mobile number.
13. I confirm that I have read and understood the Terms and Conditions governing the alert facility. If my application is accepted, I agree to comply with these terms as they may be amended from time to time. My continued use of the alert service will constitute acceptance of those terms.
14. I certify that the information provided in the application form is correct and consent to receiving notifications through the alert facility. I agree to promptly notify MegoForex.com / RBP FINIVIS PRIVATE LIMITED of any changes to the information provided.
15. I agree to provide any additional information, documentation, or Know Your Customer (KYC) requirements requested by MegoForex.com / RBP FINIVIS PRIVATE LIMITED from time to time in accordance with applicable regulatory or statutory requirements.
16. I confirm that I have received a sealed Multi Currency Forex Card kit issued by MegoForex.com / RBP FINIVIS PRIVATE LIMITED.
17. I acknowledge that the forex card will not be funded if there is any violation of limits prescribed under FEMA or if discrepancies exist in KYC documentation. In such cases, I agree that MegoForex.com / RBP FINIVIS PRIVATE LIMITED or Thomas Cook shall not be held responsible for non-funding of the card.
18. I hereby irrevocably authorize the issuing bank to block, suspend, or terminate the card if the cardholder's details or transactions appear on any watch list maintained by the bank, RBI, or any other regulatory authority, or if verification against NSDL fails. In such cases, I agree that any refund of the remaining balance on the card shall be processed directly by the issuing bank in accordance with its applicable refund procedures.

Declaration for Customers Requesting Refund "“ Thomas Cook Forex Cards

Customers requesting a refund from their MegoForex.com / RBP FINIVIS PRIVATE LIMITED "“ Thomas Cook Forex Cards must acknowledge and agree to the following declarations:

1. I confirm that I am a resident Indian and am eligible to request a refund for the value of foreign exchange available on my Forex Card.
2. I acknowledge that submitting a refund request does not automatically guarantee that the transaction will be processed. MegoForex.com / RBP FINIVIS PRIVATE LIMITED reserves the right to reject any refund request based on applicable regulatory requirements or internal policies.
3. I understand and accept that the purchase, use, and refund of foreign exchange through a Forex Card are governed by the applicable laws, rules, limits, and guidelines issued by the Reserve Bank of India (RBI) and other relevant authorities. I undertake to comply with all such laws and regulations.
4. I agree that I will be solely responsible for any penalties, legal consequences, or regulatory action that may arise under applicable laws or regulations relating to the purchase, usage, or refund of the Forex Card issued by MegoForex.com / RBP FINIVIS PRIVATE LIMITED.

Limitation of Liability (Insurance Products)

You acknowledge and agree that MegoForex.com / RBP FINIVIS PRIVATE LIMITED, including its subsidiaries, affiliates, directors, officers, employees, agents, partners, and licensors, shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, losses related to profits, goodwill, usage, data, or other intangible assets arising from the use of the website, its content, or related services, even if the Company has been advised of the possibility of such damages.
